Announcement on Prequalification

建設(shè)中國海南國際文物藝術(shù)品交易中心和三亞文化藝術(shù)中心，是落實(shí)三亞市第八次黨代會關(guān)于“六個(gè)標(biāo)桿”建設(shè)部署的重要舉措，以及三亞市“十四五”期間發(fā)展文化產(chǎn)業(yè)和提升公共文化服務(wù)水平的重大安排。為高標(biāo)準(zhǔn)、高質(zhì)量規(guī)劃建設(shè)中國海南國際文物藝術(shù)品交易中心和三亞文化藝術(shù)中心，打造新時(shí)代城市濱海會客廳和全球城市卓越水岸，特舉辦此次方案征集工作。

The construction of International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center is an important initiative to implement the construction and deployment of "six benchmarks" at the 8th Party Congress of Sanya, as well as a major step to develop cultural industry and improve the standard of public cultural services of Sanya City during the "14th Five-Year Plan" period. The Call for Proposals is hereby held with the purpose to plan and construct the International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center of high standards and high quality, and to create a coastal living room in the city for the new era and a remarkable waterfront as an international city.

本次方案征集采用公開征集的方式進(jìn)行，邀請國內(nèi)外具有豐富的類似項(xiàng)目經(jīng)驗(yàn)的設(shè)計(jì)機(jī)構(gòu)報(bào)名申請應(yīng)征，第一步通過資格審查的方式（預(yù)審）確定8個(gè)應(yīng)征人，第二步由通過資格審查的應(yīng)征人根據(jù)征集文件的要求編制設(shè)計(jì)方案。

The Call for Proposals will be carried out in an open call manner, by inviting design institutions at home and abroad with rich experiences in similar projects to apply for prequalification. The first step will determine 8 applicants through Review for Qualifications (prequalification), and in the second step, the applicants who have passed the Review for Qualifications will propose the design schemes according to the requirements of the documents of the Call.

01項(xiàng)目概況Project Brief

（一）項(xiàng)目名稱：三亞國際藝術(shù)港建筑設(shè)計(jì)方案國際征集

(I) Project Name: Call for Proposals of Architectural Design for Sanya International Art Harbor 

（二）項(xiàng)目地點(diǎn)及建設(shè)規(guī)模

(II) Project Location and Construction Scale

1.項(xiàng)目地點(diǎn)：三亞文化商務(wù)區(qū)（空間設(shè)計(jì)范圍）位于三亞灣鳳凰海岸南端，三亞河口區(qū)域，北至漁港街，南至建港路，東至勝利路。三亞國際藝術(shù)港（建筑設(shè)計(jì)范圍）位于三亞文化商務(wù)區(qū)YGHA01-01-04/07/09地塊。

1. Project location: Sanya Culture and Business District (scope of space design) is located at the Southern tip of Fenghuang Coast of Sanya Bay, Sanya estuary area, with its Northern boundary at Yugang Street, Southern boundary at Jiangang Road and Eastern boundary at Shengli Road. Sanya International Art Harbor (scope of architectural design) is located at YGHA01-01-04/07/09 plots in Sanya Culture and Business District.

2.用地面積：三亞文化商務(wù)區(qū)范圍26.7公頃，其中可開發(fā)建設(shè)用地面積16.4公頃。三亞國際藝術(shù)港用地約5.8公頃。

2. Land area: Sanya Culture and Business District covers an area of 26.7 hectares, of which 16.4 hectares is available for development and construction. Sanya International Art Harbor covers a land area of about 5.8 hectares.

3.建設(shè)內(nèi)容：三亞國際藝術(shù)港的主要功能為中國海南國際文物藝術(shù)品交易中心和三亞文化藝術(shù)中心。中國海南國際文物藝術(shù)品交易中心包含展覽展示、文物藝術(shù)品交易、藝術(shù)品機(jī)構(gòu)辦公和文物藝術(shù)品庫房等功能。三亞文化藝術(shù)中心包含歌劇廳、多功能廳及其他配套功能。三亞文化商務(wù)區(qū)將以三亞國際藝術(shù)港為核心，復(fù)合開發(fā)文化藝術(shù)、商務(wù)辦公、濱海商業(yè)、高端酒店、休閑娛樂、公共綠地、碼頭等功能，通過整體打造，發(fā)展成為三亞文化藝術(shù)的地標(biāo)性區(qū)域和重要的城市濱水公共空間。具體建設(shè)內(nèi)容以征集文件中的設(shè)計(jì)任務(wù)書為準(zhǔn)。

3. Contents of Construction: The main functions of Sanya International Art Harbor include International Cultural Relics and Artworks Trading Center of Hainan, China and Sanya Culture and Art Center. The International Cultural Relics and Artworks Trading Center of Hainan, China is featured with functions of exhibition and display, cultural relics and artworks trading, offices for organizations of artworks and cultural relics and artworks warehouse, etc. Sanya Culture and Art Center includes opera hall, multi-function hall and other ancillary functions. With Sanya International Art Harbor as the core, Sanya Culture and Business District will compose of the functions of culture and art, business office, bayfront commerce, high-end hotels, leisure and entertainment, public green space, wharf, etc., and evolve into an iconic area of Sanya culture and art and an important urban waterfront public space in an integrated approach. The specific construction contents shall be subject to the design book in the documents of the Call.

4.建筑面積：三亞文化商務(wù)區(qū)建筑面積40.9萬平方米（計(jì)容），三亞國際藝術(shù)港建筑面積8.7萬平方米（計(jì)容）。

4. Building area: Sanya Culture and Business District covers a building area of 409,000 square meters (by Floor Area Ratio Method), and Sanya International Art Harbor covers a building area of 87,000 square meters (by Floor Area Ratio Method).

5.建筑高度：三亞文化商務(wù)區(qū)標(biāo)志性塔樓建筑高度不大于220米。三亞國際藝術(shù)港建筑高度不大于24米，局部不超過35米，根據(jù)方案需要，可突破限高要求，原則上不追求以建筑高度體現(xiàn)標(biāo)志性。

5. Building height: The building height of the iconic tower in Sanya Culture and Business District shall not exceed 220m. The building height of Sanya International Art Harbor shall not be greater than 24m, with some parts not exceeding 35m. According to the requirements of the scheme, exception of the height limit can be allowed, but in principle, the building height shall not be pursued to reflect any landmark significance.

(IV) Contents of Design

1.三亞文化商務(wù)區(qū)空間設(shè)計(jì)：在鳳凰海岸及環(huán)河口地區(qū)的產(chǎn)業(yè)定位、生態(tài)定位、文化定位的研究基礎(chǔ)上，提出三亞文化商務(wù)區(qū)的產(chǎn)業(yè)及功能策劃、單元形態(tài)、建筑風(fēng)貌、地下地上空間、公共空間、交通流線等設(shè)計(jì)內(nèi)容。

1. Space Design of Sanya Culture and Business District: Based on the research of industry positioning, ecological and cultural orientations of Fenghuang coast and surrounding the estuary area, the design contents of Sanya Culture and Business District are put forward, such as industry and function planning, module form, architectural style, underground and above-ground space, public space, and traffic flow dynamic scheme, etc.

2.三亞國際藝術(shù)港建筑方案設(shè)計(jì)：包括用地紅線范圍內(nèi)的總平面圖設(shè)計(jì)、建筑設(shè)計(jì)、功能布局、流線組織、重要空間的室內(nèi)設(shè)計(jì)、室外景觀設(shè)計(jì)等設(shè)計(jì)內(nèi)容。

2. The architectural design of Sanya International Art Harbor includes: the general floor plan design, architectural design, functional layout, traffic dynamics organization, interior design of important spaces, outdoor landscape design and other design contents within the red-lined boundary of land use.

（五）設(shè)計(jì)周期：應(yīng)征階段設(shè)計(jì)周期為89天。計(jì)劃在2022年5月27日（北京時(shí)間，下同）發(fā)出征集文件，2022年8月24日應(yīng)征人遞交應(yīng)征成果。

(V) Cycle of Design: The turnaround period of design at the Proposal Phase is 89 days. It is planned to release the documents of the Call on May 27, 2022 (Beijing time, the same hereinafter), and Applicants shall submit deliverables on August 24, 2022.

（六）資格審查的方式：有限數(shù)量制。參加征集活動(dòng)的應(yīng)征人（含聯(lián)合體應(yīng)征人）的數(shù)量限定為8個(gè)。

(VI) Method of Review for Qualifications: Limited number of applicants permitted. The number of Applicants for such Call (including Consortium Applicants) is limited to 8. 

（七）獎(jiǎng)項(xiàng)設(shè)置：優(yōu)勝獎(jiǎng)3個(gè)。

02應(yīng)征申請人資格條件Eligibility and Qualifications of Applicants

（一）應(yīng)征申請人應(yīng)為合法注冊的法人實(shí)體或由合法注冊的法人實(shí)體組成的項(xiàng)目聯(lián)合體。

(I) The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.

（二）中華人民共和國境內(nèi)的設(shè)計(jì)機(jī)構(gòu)須具有建筑行業(yè)（建筑工程）設(shè)計(jì)甲級資質(zhì)或建筑行業(yè)設(shè)計(jì)甲級資質(zhì)或工程設(shè)計(jì)綜合甲級資質(zhì)；中華人民共和國境外的設(shè)計(jì)機(jī)構(gòu)須具有所在國頒發(fā)的從事建筑設(shè)計(jì)的相應(yīng)資格。港澳臺設(shè)計(jì)機(jī)構(gòu)的資格要求應(yīng)參照境外設(shè)計(jì)機(jī)構(gòu)資格要求的規(guī)定。

(II) The Applicant (design institution) within the territory of the People's Republic of China shall be at least certified with one of the following: Grade A qualification for design in the architectural industry (architectural engineering) or Grade A qualification for design in the architectural industry or Comprehensive Grade A qualification for engineering design; the Applicant (design institution) outside the territory of the People's Republic of China shall hold corresponding qualifications issued by governmental authorities in its residence country or region for engaging in architectural design. The requirements of qualifications for design institutions from Hong Kong, Macau and Taiwan shall refer to the requirements of qualifications for design institutions outside the territory of the People’s Republic of China.

（三）上述具有相應(yīng)資質(zhì)/資格的設(shè)計(jì)機(jī)構(gòu)可單獨(dú)提出資格預(yù)審申請，也可組成聯(lián)合體共同提出資格預(yù)審申請，但需以聯(lián)合體協(xié)議書明確聯(lián)合體的牽頭單位和各自職責(zé)。組成項(xiàng)目聯(lián)合體的各成員單位不得再以自己的名義單獨(dú)進(jìn)行資格預(yù)審申請，也不得同時(shí)加入本項(xiàng)目其它聯(lián)合體進(jìn)行資格預(yù)審申請。

(III) The above design institutions with corresponding credentials/qualifications can apply for prequalification individually, or can form a consortium to apply for prequalification, but the design institutions applying for prequalification in the capacity of a consortium shall specify the lead partner and their respective responsibilities of each partner by a Consortium Agreement. Any partner of the Consortium shall neither individually apply for prequalification in its own capacity, nor concurrently apply for the Prequalification as a partner of another Consortium in the Proposal Project.

（四）應(yīng)征申請人應(yīng)具有與本項(xiàng)目的功能性質(zhì)相類似的設(shè)計(jì)經(jīng)驗(yàn)。

(IV) The Applicant shall have had design experiences similar in functions and nature to the Proposal Project.

（五）應(yīng)征申請人參加本次活動(dòng)的設(shè)計(jì)人員應(yīng)是其機(jī)構(gòu)正式在冊人員，首席設(shè)計(jì)師必須由應(yīng)征申請人單位中主持過類似項(xiàng)目（劇院、音樂廳、藝術(shù)品交易中心、美術(shù)館或其他文化公共建筑等）的設(shè)計(jì)師擔(dān)任。

(V) The designers who are going to take part in the Call must be incumbent officially documented employees of the Applicant. The Chief Designer must have experience in leading comparable design projects (theater, concert hall, art trading center, art gallery or other cultural public buildings, etc.) at the Applicant. 

說明：除聯(lián)合體的成員外，參加征集的應(yīng)征人之間不應(yīng)存在關(guān)聯(lián)關(guān)系。

Note: Except for partners of a Consortium, the Applicants in the Call shall not constitute or bear any affiliations. 

符合以上條件的應(yīng)征申請人可自2022年5月6日至2022年5月18日，每天上午9時(shí)00分至11時(shí)30分，下午13時(shí)30分至16時(shí)00分在組織單位進(jìn)行報(bào)名登記后獲取資格預(yù)審文件。

Any Applicant who meets the aforesaid criteria may sign up and register with the Organizer and obtain prequalification documents from 9:00 a.m. to 11:30 a.m. and 13:30 to 16:00 in the afternoon each day, from May 6, 2022 to May 18, 2022.

03征集活動(dòng)時(shí)間安排Timetable of the Call

（一）資格預(yù)審階段（2022年5月6日～2022年5月26日）

(I) Prequalification Phase (May 6,2022~May 26,2022)

（二）應(yīng)征階段（設(shè)計(jì)階段）（2022年5月27日～2022年8月24日）

(II) Proposal Phase（Design Phase）(May 27,2022~August 24, 2022)

以上時(shí)間為計(jì)劃時(shí)間，若有調(diào)整將另行通知。

The date and time given above is scheduled date and time and may be subject to changes until further notice.

特別提示：境外應(yīng)征申請人負(fù)責(zé)本項(xiàng)目主要人員請?zhí)崆白龊煤炞C準(zhǔn)備，以便入圍后按期赴三亞參加項(xiàng)目介紹會及現(xiàn)場踏勘。應(yīng)征人首席設(shè)計(jì)師原則上必須參加現(xiàn)場踏勘，但因新型冠狀病毒肺炎疫情，無法參加現(xiàn)場踏勘的，應(yīng)提前向主辦單位作出書面說明。

Warm Tip: Foreign applicants should get visas ready in advance for key staff members who will take responsibility for the Proposal Project, so that they will be able to arrive in Sanya for the project briefing and site as scheduled after being shortlisted. In principle, the Chief Designer from the Applicant must be present for site survey. Nevertheless, if such presence in the site survey can not be realized due to the COVID-19 pandemic, a written explanation to the Sponsor shall be made in advance.

05資格預(yù)審文件的獲取Obtaining of Prequalification Documents

應(yīng)征申請人請于2022年5月6日至2022年5月18日，每天上午9時(shí)00分至11時(shí)30分，下午13時(shí)30分至16時(shí)00分在組織單位報(bào)名登記，并在其網(wǎng)站（http://www.bkpmzb.com/）上免費(fèi)下載資格預(yù)審文件。只有符合條件，并在組織單位報(bào)名登記的應(yīng)征申請人才能獲得下載資格預(yù)審文件的密碼，正式參加資格預(yù)審。

The Applicant shall sign up and register with the Organizer from 9:00 a.m. to 11:30a.m, from 13:30 to 16:00 in the afternoon each day, from May 6,2022 to May 18,2022, and download the prequalification documents from its website（http://www.bkpmzb.com/）for free. Only those Applicants that meet criteria and have signed up and registered with the Organizer will receive a password for downloading prequalification documents and be eligible for prequalification. 

報(bào)名登記的程序：①在組織單位網(wǎng)站上下載報(bào)名表；②填寫報(bào)名表后，將底稿（doc格式）及加蓋單位印章的掃描件（pdf格式）以電子郵件的方式發(fā)回；③組織單位確認(rèn)應(yīng)征申請人的報(bào)名資格并進(jìn)行登記。

Signup and Registration steps: ① The Applicant downloads the registration form from the website of the Organizer; ②The Applicant completes the registration form and returns the original document (in doc format) and a scanned copy affixed with the company seal (in pdf format) to the Organizer by email; ③ the Organizer confirms the eligibility of the Applicant and gets it registered.

06資格預(yù)審申請文件的遞交時(shí)間Submission Deadline of Application Documents for Prequalification

應(yīng)征申請人請于2022年5月20日16時(shí)00分前，將資格預(yù)審申請文件的表格部分（doc格式）先行通過電子郵件的方式發(fā)送給組織單位，并請于2022年5月23日12時(shí)00分前將資格預(yù)審申請文件的文本文件（1正1副）及電子文件（2套）送交組織單位。

The Applicant is required to send those forms (in doc format) in the application documents for prequalification to the Organizer by email first prior to 16:00 on May 20,2022, and then submit textual documents in the application documents for prequalification (1 original and 1 copy) and electronic files (2 sets) to the Organizer no later than 12:00 on May 23,2022.

07應(yīng)征補(bǔ)償費(fèi)及獎(jiǎng)項(xiàng)的設(shè)置Compensations and Prizes for Application

（一）提交了合格應(yīng)征方案的應(yīng)征人將獲得應(yīng)征補(bǔ)償費(fèi)，應(yīng)征補(bǔ)償費(fèi)為人民幣120萬元/應(yīng)征人（含中國境內(nèi)、外應(yīng)繳納的各項(xiàng)稅費(fèi)）。但對于未按規(guī)定時(shí)間提交應(yīng)征文件或其應(yīng)征文件按征集文件規(guī)定不被接受或應(yīng)征資格被取消的應(yīng)征人，承辦單位將不支付應(yīng)征補(bǔ)償費(fèi)。

(I) The applicants who have submitted proper proposals will receive a compensation of RMB 1,200,000 (inclusive of various taxes or levies payable both inside and outside China). However, the Undertaker will not pay any compensation to any Applicant that has failed to submit a proposal within the specified deadline or that has submitted a proposal that is considered unacceptable in light of the requirements of the documents of the Call or that has been disqualified. 

（二）應(yīng)征設(shè)計(jì)方案評審委員會將從應(yīng)征設(shè)計(jì)方案中評選出3個(gè)優(yōu)勝獎(jiǎng)，獲獎(jiǎng)的3個(gè)應(yīng)征人須按照主辦單位（承辦單位）的深化設(shè)計(jì)要求對其提交的設(shè)計(jì)成果進(jìn)行優(yōu)化和深化，深化費(fèi)用為人民幣150萬元/應(yīng)征人（含中國境內(nèi)、外應(yīng)繳納的各項(xiàng)稅費(fèi)）。

(II) The Evaluation Committee of the design proposals will select three winners from the submissions. The three winning Applicants shall optimize and deepen their design deliverables according to the detailed design requirements of the Sponsor (Undertaker). The compensation for detailed design is RMB 1.5 million/Applicant (inclusive of various taxes or levies payable inside and outside China).

（三）獲得優(yōu)勝獎(jiǎng)的3個(gè)應(yīng)征人對各自的設(shè)計(jì)方案進(jìn)行深化后提交主辦單位審議。主辦單位可選擇其中一個(gè)方案確定為中標(biāo)候選方案。中標(biāo)人的設(shè)計(jì)費(fèi)中將等額扣除已支付的深化設(shè)計(jì)費(fèi)用150萬元。

(III) The three winners who have won the prize shall further deepen their own design proposals and submit them to the Sponsor for review. The Sponsor may choose one of the proposals to determine the awarded candidate. The awarded bidder's design fee will be equal to the amount after deducting RMB 1.5 million, the detailed design fee already paid.

08其它條款Miscellaneous

（一）本次征集活動(dòng)設(shè)計(jì)成果提交日期為2022年8月24日。

(I) The deadline for submission of design deliverables in this Call is August 24,2022.

（二）知識產(chǎn)權(quán)

(II) Intellectual Property Rights

1.應(yīng)征人擁有設(shè)計(jì)方案的著作權(quán)（版權(quán)）。經(jīng)主辦單位（承辦單位）書面許可后，應(yīng)征人可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價(jià)、展示其應(yīng)征作品。應(yīng)征人不得將應(yīng)征設(shè)計(jì)方案用于本征集項(xiàng)目以外的其他任何項(xiàng)目。

1. The Applicant owns the authorship (copyright) of the design proposal. With the written permission of the Sponsor (Undertaker), the Applicant may comment on and display the proposal works for Application via media communications, trade magazines, publications or by other means. The Applicant shall not use the design proposals for any project other than this project herein.

2.應(yīng)征人應(yīng)保證其提交的全部設(shè)計(jì)文件在中國境內(nèi)或境外沒有且不會侵犯任何其他人的知識產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。如果其應(yīng)征人的設(shè)計(jì)文件使用或包含任何其他人的知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人應(yīng)已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔(dān)。

2. The Applicant shall ensure that all design documents submitted do not and will not infringe the IPR (intellectual property rights) (including but not limited to copyright and patent rights), proprietary technologies or business secrets of others within or outside the People’s Republic of China. If the design documents of the Applicant use or include IPR or proprietary technologies or trade secrets of others, the Applicant shall have already obtained legitimate, valid and sufficient authorization from the right holders. The Applicant shall take all liabilities for any compensations arising from infringement upon IPR or proprietary technologies or trade secrets of others.

3. 主辦單位（承辦單位）擁有應(yīng)征設(shè)計(jì)方案的使用權(quán)，可對應(yīng)征設(shè)計(jì)方案匯編、印刷、出版和展覽，可通過傳播媒介、專業(yè)雜志、書刊或其他形式評價(jià)、展示、宣傳應(yīng)征作品。主辦單位（承辦單位）有權(quán)在項(xiàng)目的規(guī)劃和設(shè)計(jì)中或在設(shè)計(jì)方案調(diào)整綜合時(shí)，全部或部分使用應(yīng)征設(shè)計(jì)方案的內(nèi)容，也可以對應(yīng)征設(shè)計(jì)方案進(jìn)行修改。未經(jīng)應(yīng)征人書面同意，主辦單位（承辦單位）不得將應(yīng)征設(shè)計(jì)方案用于本次方案征集項(xiàng)目范圍以外的其他建設(shè)項(xiàng)目。

3. The Sponsor (Undertaker) has the right of use over the design proposals submitted by all Applicants, may also compile, print, publish and exhibit the design proposals, or comment on, display and publicize the proposal works for Application via media communications, trade magazines, publications or by other means. The Sponsor (Undertaker) has the right to use any design proposal in its entirety or partially in the planning and design of the Proposal Project or in modification or consolidation of the design proposals, or to revise any design proposal. Without the written consent of the Applicant, the Sponsor (Undertaker) shall use the design proposals for other construction projects beyond the scope of the project in this Call.

4.聯(lián)合體應(yīng)征人合作完成的設(shè)計(jì)方案，其知識產(chǎn)權(quán)由聯(lián)合體成員共同所有。

4. The intellectual property rights of the design proposals completed by the Consortium Applicants shall be jointly owned by the Consortium partners.

（三）本次征集活動(dòng)中的所有文件及往來信函均應(yīng)使用中文書寫。

(III) All documents and correspondences related to the Call shall be written in Chinese. 

（四）設(shè)計(jì)機(jī)構(gòu)所獲的應(yīng)征補(bǔ)償費(fèi)或深化費(fèi)用的稅金（含中國境內(nèi)、外應(yīng)繳納的各項(xiàng)稅費(fèi)）和在咨詢過程中發(fā)生的一切費(fèi)用自理。

(IV) Any taxes imposed on the compensations for applications or for detailed design paid to the Applicant (inclusive of any taxes or levies payable inside and outside China) and any costs arising from the consulting shall be borne by the Applicant. 

（五）參加本次活動(dòng)的應(yīng)征申請人均被視為承認(rèn)本公告的所有條款。

(V) By participating in the Call, the Applicant is deemed to have acknowledged and accepted all terms and conditions contained in the Announcement herein. 

（六）三亞市人民政府擁有本次公告的解釋權(quán)。

(VI) The Sanya Municipal People's Government reserves the right of interpretation of the Announcement. 

（七）本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國的法律和法規(guī)。

(VII) The Call per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
